Pooled Supplemental Needs Trusts

Protect Benefit Eligibility

Federal and New York State law both permit a person of any age with a disability (as defined by the Social Security Administration) to protect financial resources for the purpose of maintaining eligibility for government benefits by using a pooled supplemental needs trust (SNT).

By protecting excess monthly income and resources for a person with a disability, a pooled SNT can secure a person's eligibility for benefits and improve their quality of life considerably.

As Trustee, NYSARC will administer the account and distribute funds for the sole benefit of the beneficiary to purchase eligible items and services when provided with required documentation. Trust funds can pay for many things, but not all requests can be paid and are made at the sole discretion of the Trustees.

A qualifying pooled supplemental needs trust must meet the following criteria as defined by the Social Security Administration (SSA) program operations manual system (POMS):

  • The pooled trust is established and maintained by a nonprofit association;
  • Separate accounts are maintained for each beneficiary, but assets are pooled for investing and management purposes;
  • Accounts are established solely for the benefit of the disabled individuals;
  • The account in the trust is established through the actions of the individual, a parent, grandparent, legal guardian, or a court; and
  • The trust provides that to the extent any amounts remaining in the beneficiary’s account upon the death of the beneficiary are not retained by the trust, the trust will pay to the State(s) the amount remaining up to an amount equal to the total amount of medical assistance paid on behalf of the beneficiary under State Medicaid plan(s).
